This site is owned and operated by Flying Fairy Company (Hereafter “FLYING FAIRY”). These terms and conditions include general terms and conditions for use of this Site, terms and conditions relating to the services provided by Flying Fairy on the site and in our studio.
These Terms and Conditions are incorporated into the Registration Form, Release and Waiver of Liability Form and any Membership is subject to these Terms and Conditions as amended from time to time.
Flying Fairy reserves the right to vary and revoke these Terms and Conditions from time to time which it may consider necessary or desirable for the regulation of the internal affairs of the Studios and/or the conduct of Members. Any such changes will be published on the Website and, until revoked, are binding on Members.
Please read these terms and conditions carefully. Your use of the Site, the purchase of any Products or Services on this Site or in a studio will be subject to these terms and conditions. And you now hereby agree to our terms and conditions.
TERMS & CONDITIONS
Classes are always subject to availability but at Flying Fairy we will always do our best to accommodate you in your chosen class.
All classes must be prepaid online and all clients agree to our 6hrs notice policy when cancelling and/or rescheduling. So if you’re booked into a class, but miss it or cancel with less than 6 hours’ notice, you will be charged for it.
Out of consideration for the trainer and other members, and also for your own safety (the warm-up is an important aspect of each class) please be aware that if you are more than 15 minutes late for a class, you may not be allowed to join the class and you will be charged for it.
Bookings are made through an online booking system. You may reserve a class on our website, or on the online booking system.
Classes require 3 or more people in order to take place. If any cancellation, we will notify you by email at least 3 hours before the class time and that class will not be charged. Students may contact us for extension of the package if the same class has been cancelled 2 weeks in a row.
Members with low/high blood pressure and/or cardiac irregularities should not attend class until they have written permission from their doctor. If there is any doubt, the Member should consult his/her doctor. Members must notify the Studio of any circumstances affecting their health, which may be exacerbated through continued use of the Studio.
IMPORTANT LIABILITY STATEMENT
The information available on or through this Site, and the Services supplied via or in connection with this Site or at Flying Fairy Company do not constitute medical advice and it is your responsibility to determine, through obtaining appropriate medical advice, that you are fit and well and that such contents and services are suitable for you. It is not our responsibility to do so. Before commencing any exercise regime, you should consult your doctor.
In consideration of Flying Fairy Company accepting a person as a Member, the Member agrees that:
Neither Flying Fairy Company, nor its partners, instructors and employees are responsible for any injuries suffered by the member caused whole or in part by the Member’s failure to faithfully follow the instructions of the instructor or by any physical impairment of yours not fully disclosed to the Studio in writing.
It is also vital that you supply us with correct information about yourself. We cannot be liable for any incorrect information supplied by you to us. We try to make sure that all information contained on this website (and provided by us to you as part of any Services or Products) is correct, but, subject to the paragraph below, we do not accept any liability for any error or omission and exclude all liability for any action you (your legal representatives, heirs) may take or loss or injury you may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this website or provided through any Service supplied by us to you.
Neither Flying Fairy Company, nor its partners, instructors and employees are responsible for loss or damage to a Member’s personal belongings.
Flying Fairy Company reserves the right to change the class schedule, including cancellation of individual classes and change of instructor without notice
You, your legal representatives and your heirs release waive, discharge and covenant, not to sue Flying Fairy Company, its partners, instructors and employees for any injury or death caused by their negligence or other acts.
PERSONAL BELONGINGS, DRESS & SAFETY
For security reasons Members are advised to place all their valuables in a safe place.
Flying Fairy studio is a shoe free zone. All outdoor footwear is to be removed as soon as possible and place your shoes on the shoe rack at the entrance.
For safety reasons and because all Members are barefoot – No crockery, glass or anything breakable is permitted in any part of the Studios.
No food is to be consumed within the yoga studio.
Members should not walk around the Studios barefoot if they have verrucas or similar foot complaints.
Members are required to use a suitable towel for the purpose of cleaning their yoga mat in the studio.
In the event of a fire, Members are asked to make their way to the nearest available exit.
PASSES, PACKAGES & GIFT CARDS
All Trial Passes is only valid for first-time visitors and not applicable for past or existing Flying Fairy students.
In case of breaking the rules, your purchase will not be refunded and the trail pass will also be considered invalid and void.
All passes and packages are active from the day of purchase. (Excluding single sessions and 7-Day Trail pass).
All passes and packages are non-refundable, non-transferable and cannot be shared.
Online registration is indispensable. Please reserve your class / studio rental online.

Any class passes can be extended once during the validity period due to medical reasons (Doctor's certificate required). The extension date must not exceed one month after the due date of the class pass.
In the event you have to cancel a class booking, our cancellation policy is as follows:

For group classes, students must cancel / reschedule at least 6 hours before the class starts. (for cancellation without being charged)
For private classes, students must cancel / reschedule at least 1 day before the class starts. (for cancellation without being charged)
Self cancel / reschedule online by logging into your account.
All group classes that are not cancelled / rescheduled at least 6 hours beforehand, will be charged for the session in full for the class.

Single Class that missed the cancellation time can only be rescheduled once due to medical reasons. The extension date shall not exceed 2 weeks after the original class date. (Doctor's note required)

Flying Fairy has the right to cancel any classes at any time.

Clients might not allow to attend the class if arriving late more than 15 mins and fees will be charged in full for the class.
All classes cancelled automatically if the black rainstorm / Typhoon T8 warning or above is hoisted. We will notify you by email / text about the cancellation and you will have to reschedule the class online by yourself.
Students may contact us for extension of the package if the same class has been cancelled 2 weeks in a row.
1. Booking Procedure:
1.1 All reservations must be made through our website or the online booking system.
1.2 Advance payment is required to secure all studio bookings at The Place. We reserve the right to cancel any booking where payment is not received before the event.
1.3 An invoice is raised as soon as a booking is made on our booking system. If cancellation is made within 6 hours or less of the booking time, then the total amount on the invoice will be liable. If the booking is cancelled before the required 6 hours’ notice a cancellation fee will not apply.
1.4 Our online booking system sends out an automatic confirmation once a booking is paid for; this outlines the dates, times and location of each booking. It is your responsibility to ensure you have received this message and that the information is correct. If you do not receive this message, please contact us as soon as possible. The same rules and procedure apply for booking cancellations.
1.5 Studio times and locations may be changed or cancelled in exceptional circumstances by Flying Fairy due to changes in the internal programme. You will be given notice of cancellation in writing as far in advance of the booking date and time as is reasonably practicable.
1.6 Studio is limited to yoga related activities, you may asked to leave if you're using the studio improperly and the total amount of the studio rental will be liable.
2. Footwear, Food & Drinks in the Studio:
2.1 Flying Fairy studio is a shoe free zone. All outdoor footwear should be placed on the shoe rack at the entrance.
2.2 No food or drink may be taken into the studio except bottled water.
3. Damage to the Studio:
3.1 You will be liable for any damage caused to the studio. This includes (without any limitation) damage to the studio’s floors, walls, equipments or audio-visual system. You are responsible for informing us in advance if you notice anything unusual in the condition of the studio.
4. Booking Times:
4.1 You must keep to your allotted time slots and you must ensure that warm-up and cool-down is allowed for within the booking time.
4.2 If you persistently fail to keep to your allotted time, we reserve the rights to invoice for any extra time in the studio according to the time of your stay.
5. Use of Equipment:
5.1 Equipment may moved according to your purpose of use of the studio. Please keep the place tidy and place the equipment where its belong after the use.
5.2 The studio is equipped with Wi-Fi signal, details of which can be found on the confirmation letter we sent by email after your purchase.
6. Photos & Videos:
6.1 Any hire involving photography and video footage for commercial use must be agreed at the time of booking as different rates apply. Please contact us at email@example.com for more information.
6.1 If the images will be broadcasted we might be interested in using the images, videos or stills from such shoots in our communication activities.
7. Health & Safety, Best Practice and Public Liability:
7.1 You are responsible for ensuring your session is run in line with current health and safety legislation and best practice guidelines. Flying Fairy takes no responsibility for the content or health and safety of classes run by external hirers.
7.2 We are not liable for and cannot cover loss of your personal property.
7.3 Hirers need to have their own insurance to cover any situation involving loss or injury to a member of the public as a result of their own activities.
7.4 If a session involves participants who are under the age of 18 or classed as vulnerable adults the hirer is responsible for ensuring that the relevant DBS checks have been obtained.
7.5 Hirers are advised not to exceed the recommended studio maximum capacity (see below).
8. Location & Building Facilities:
8.1 Our studios are located in Tuen Mun Central Square in Tuen Mun. and Wah Hing Commercial Building in Wan Chai.
8.2 All studio users may asked to report at the information centre at the entrance of the building which is attended every day after 10p.m..
8.3 There are toilets on each floor of the building.
9. Pricing & Studio Specificities:
9.1 Rates are calculated by hour (minimum one hour hire).
9.2 Maximum capacity is recommended for different activities. Tuen Mun: 7 pax for aerial hammock / 6 pax for aerial hoop or aerial sling / 10 pax for yoga. Wan Chai: 7 pax for hammock / 8 pax for aerial hoop / aerial sling / 12 pax for yoga.
Courses are sold in blocks of 2 or 4 or such other combinations as Flying Fairy may introduce from time to time. The Client Shall not transfer sessions to any other person or permit them to be used by anyone other than the Client. Any assignment, transfer or disposal of courses is at the sole discretion of Flying Fairy and may only be permitted in exceptional circumstances. Class fees are non refundable.
Class fees may be increased by Flying Fairy at any time without prior notice .
Details of class times at the Studio may vary from time to time. Classes will be published by the Studio and will be available on our social media platform or our Website(s).
Any booked sessions must be cancelled online within 6 hours. In any other case, the session will be charged and deducted from the remainder of the Client’s course.
When you are purchasing a class you are paying for a class and not an instructor. Instructors are subject to change without notice.
Trial Passes expire in 1 month if not used.
7-Day Trial Pass expires in 7 days.
12 credit pack expires in 56 days.
32 credit pack expires in 126 days.
60 credit pack expires in 231 days.
120 credit pack expires in 455 days.
In these terms and conditions, the following definitions apply: “Services” means any information and services ordered and/or provided by Flying Fairy through or via the Site or our studios and all services offered as part of any course or workshop. “Products” means any products offered for sale on the Site or in a Flying Fairy studio. “Site” means the website at the URL https://www.flyingfairyaerial.com or replacement site(s) from time to time.
SITE USAGE and INTELLECTUAL PROPERTY RIGHTS
You may use the Site for personal and lawful use and in accordance with these terms and you are not allowed to copy or use any material from the Site for any commercial purpose.
The website supports English and Chinese versions, except for the Terms & Policies, Member Pages and Booking Pages.
The intellectual property rights in all contents of the Site and supplied as part of the Products or Services. Except to the extent expressly set out in these terms and conditions, you are not allowed to make any copies of any part of any Materials, or remove or change anything on the Site, include or create links to or from the Site without our written authority, or remove or change Flying Fairy logo or other intellectual property right notices contained in any Materials or copies thereof. You must not use the Flying Fairy Company brand, logos or marks without written licence.
You must not use the Site to post, upload or otherwise transmit material which is obscene or pornographic, threatening, menacing, racist, offensive, defamatory, infringing of any intellectual property or otherwise unlawful, to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this Site or any other related computer system, to make excessive traffic demands, deliver viruses or forward chain letters or similar materials that may reasonably be expected to inhibit other users from using and enjoying the Site or any other web site or damage or destroy the reputation of Flying Fairy Company.
Flying Fairy accepts no obligation to monitor the use of the Site. However, Flying Fairy Company reserves the right to disclose any information as required by law and/or to remove, refuse to post or to edit any information or materials, to block your access and to take such other action as may be reasonably necessary to prevent any breach of these terms and conditions or any breach of applicable law or regulation. Flying Fairy Company will also in its absolute discretion fully co-operate with law enforcement and other relevant authorities with respect to any investigation of suspected unlawful activity or violation of network security. You should refresh your browser each time you visit the Site to ensure that you download the most up to date version of the Site as we may change the site from time to time.
You are referred to the important liability statement at the top of these terms and conditions. Subject to that statement you agree that your use of this Site and the Service is on an “as is” and “as available” basis. On that basis, except as expressly set out in these terms, Flying Fairy Company does not enter into conditions, warranties or other terms in relation to the Site or the Products or the Services (including any implied term relating to quality, fitness for a particular purpose) or any guaranteed or predicted result.
The Site may include links to external sites and co-branded pages. Flying Fairy Company has included links to these sites and co-branded pages to provide you with access to information and services that you may find useful or interesting, However, Flying Fairy Company is not responsible for the content of these site and pages or for anything provided by them.
Subject to the important liability statement, Flying Fairy Company is not liable for failure to comply with these terms and conditions due to any event beyond its reasonable control, including, without limitation, the input of incorrect information by you.
SUSPENSION and TERMINATION of SERVICE
Flying Fairy may suspend the operation of the Site for repair or maintenance work or in order to update or upgrade the contents or functionality of the Site from time to time. Access to or use of the Site or any Sites or pages linked to it will be not necessarily be uninterrupted or error free.
Flying Fairy may terminate the Service immediately in the event you breach any of these terms and conditions or do not pay any sums due to Flying Fairy (including if the credit/debit card you use is not valid or does not work for another reason).
USE OF FACILITIES
Classes start promptly at the advertised times. Members need to arrive at the Studios with enough time to change and enter the yoga studio before the class starts. The door will be locked 15 mins after the class start and you will not be allowed to attend that class and we will charge you in full for an amount equal to the cost of the class.
Baskets are available to Members while they are attending class and are emptied every night. Any items left in the baskets at the end of the day are placed in lost property.
All lost and left property is disposed of within 7 days with the exception of towels which are disposed of on a daily basis.
Information displayed on the Site, Booking System or in Our Studio as to pricing and availability is subject to change by Flying Fairy without notice.
1. ONLINE RESERVATIONS
Class size is limited and Flying Fairy operates a “first come first served” booking policy. We only take online reservations, you shall reserve your class online before you come.
Flying Fairy may change these terms and conditions from time to time. By browsing the Site you are accepting that you are bound by the current terms and conditions.
You should check these each time you revisit the Site. These terms and conditions form the entire understanding of the parties and supersede all previous agreements, understandings and representations relating to the subject matter.
These terms and conditions shall be governed and interpreted in accordance with Hong Kong law, and you consent to the non-exclusive jurisdiction of the Hong Kong courts.
